These Terms and Conditions ("Terms") govern your use of Skylar Automation LLC's website at skylarautomation.ai and all related services, including the NeverMiss missed-call text-back platform ("Services"). By using our Services, you agree to these Terms.

About our services

Skylar Automation LLC is an Oregon-based automation and AI consultancy providing SMS communication tools, marketing automation, and digital services to small businesses. Our NeverMiss service enables businesses to automatically send SMS responses to callers who reach an unanswered phone line.

SMS messaging terms

Message and data rates may apply to all SMS messages sent or received through our platform. Contact your wireless carrier for details about your messaging plan.

How it works: When you call a business using NeverMiss and your call goes unanswered, you may receive an automated SMS from that business. This message is sent on behalf of the business, not by Skylar Automation directly.

Message frequency: You will receive one (1) automated SMS per missed call event. If you reply to that message, additional messages may be exchanged as part of a customer service conversation with the business.

Opt-out: You may opt out of receiving SMS messages at any time by replying STOP to any message. After opting out, you will receive a single confirmation and no further automated messages will be sent to your number from that business.

No mobile number sharing: Mobile phone numbers collected through our SMS system are never sold, rented, or shared with third parties for marketing purposes.

Supported carriers: Our SMS service is available on all major US carriers including AT&T, T-Mobile, Verizon, and others. Carrier support may vary.

Business client responsibilities

Businesses using NeverMiss agree to:

Use the service only for legitimate customer care and service communications
Not use the service for unsolicited marketing, spam, or deceptive messaging
Honor all opt-out requests promptly and completely
Comply with all applicable laws including the TCPA, CAN-SPAM Act, and CTIA guidelines
Ensure their use of the platform does not violate Twilio's Acceptable Use Policy

Acceptable use

You may not use our Services to:

Send spam, unsolicited messages, or bulk commercial communications
Harass, threaten, or harm any individual
Violate any federal, state, or local law or regulation
Impersonate any person or business
Transmit content that is illegal, obscene, or fraudulent

Intellectual property

All content on skylarautomation.ai, including text, graphics, logos, and software, is the property of Skylar Automation LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

Disclaimer of warranties

Our Services are provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free service. SMS delivery is subject to carrier availability and conditions outside our control.

Limitation of liability

To the maximum extent permitted by law, Skylar Automation LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our Services, including but not limited to lost profits, missed communications, or data loss. Our total liability for any claim shall not exceed the amount you paid us in the 30 days preceding the claim.

Indemnification

You agree to indemnify and hold harmless Skylar Automation LLC and its officers, employees, and agents from any claims, losses, or damages arising from your use of the Services or your violation of these Terms.

Governing law

These Terms are governed by the laws of the State of Oregon, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Marion County, Oregon.

Changes to these terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of our Services after changes are posted constitutes acceptance of the revised Terms.
